Military Leave

It is Veritas' intent to comply with all requirements of USERRA.

 Reservist Duty

Active Duty

The Uniformed Services Employment and Reemployment Rights Act of 1994 ("USERRA") governs the rights of employees who temporarily leave their jobs as a result of their voluntary or involuntary service in the United States uniformed services.

You have the right to be re-employed with Veritas if you leave and you:

  • Ensure that you provide advance written notice of your service and a copy of your military orders.
  • Have five years or less of cumulative service in the uniformed services while with Veritas (except in certain cases where military service continues because of war or national emergency).
  • Return to work or apply for reemployment in a timely manner after conclusion of service.
  • Have not been separated from service with a disqualifying discharge or under other than honorable conditions.
What to Do When: You're Going on Active Duty Military Leave
Before Leave Begins:
  • Notify your manager as soon as possible. (The notice requirement is excused when military necessity prevents an employee from giving notice or circumstances make it impossible or unreasonable for notice to be provided.)
  • When possible, provide an estimate of your military pay to the HR vHelp.
  • Initiate your claim by contacting our claims administrator, Liberty (company code: Veritas) or call 1-888-404-18831-888-404-1883 FREE.
  • Check the status of a claim/leave on MyLibertyConnection.com.
During the First 180 Days of Leave:
  • Notify your manager and Liberty of your intention to return to work.
  • Advise and provide paystubs of all earnings received from military duty for the time period administered by Liberty to the HR vHelp.
Beginning on the 181st Day of Leave:
  • Elect COBRA if you want to continue your Veritas benefits.
Return to Work:
  • Initiate status changes to your benefits if applicable
  • If overpayment occurred during your leave, work with ADP to return excess payment.

Effect on Pay

Veritas will continue your regular pay with the offset from all earnings received from military duty for the duration of your active military leave up to 180 days. Your leave will be unpaid beginning the 181st day of your leave.

It is important that you advise the HR vHelp of your earnings from military duty as soon as possible to avoid overpayment from Veritas payroll.

Protection under USERRA

Uniformed Services: Army, Navy, Marine Corps., Air Force, Coast Guard, Army National Guard, Air National Guard, and the Commissioned Corps of the Public Health Service. It also includes Reserves of the Army, Navy, Marine Corps, Air Force, and Coast Guard, as well as any other category of persons designated by the President in time of war or emergency.

Service in the uniformed services: the performance of duty on a voluntary or involuntary basis, including active duty, active duty for training, initial active duty for training, inactive duty training, and full-time National Guard duty. It also includes time that an employee is absent from work for an examination to determine if he or she is fit for any of the above-referenced types of duty, and for funeral honors duty performed by members of the National Guard or Reserves.

Employment Reinstatement Rights
Reemployment rights are guaranteed under USERRA, subject to certain requirements. You will have the following deadlines to exercise your reemployment rights:

Time Away from Veritas Report to Work
Less than 31 days or an exam to determine fitness for military service Eight hours following your return from service to report for your next scheduled work period.
Between 31 and 180 days 14 days following your return from service to apply for reemployment.
More than 181 days 90 days following your return from service to apply for reemployment.

Health Care Benefits (Medical, Dental, Vision)
Employee Assistance Program
Coverage continues for the first 180 days of active reserve military leave. Afterwards, coverage will be offered through COBRA at your own expense.
Life and AD&D Insurance Coverage terminates on your last day of active employment at Veritas. The employee should discuss military life insurance coverage with representatives of the relevant branch of the services.
Health Care Flexible Spending Account Contributions cease with your last Veritas paycheck. Afterwards, coverage will be offered through COBRA. If you elect COBRA, you may continue to incur expenses through the remainder of the calendar year and submit claims for eligible expenses (incurred prior to December 31st) through March 31st of the following calendar year.
Dependent Care Flexible Spending Account Contributions cease. Within 31 days after you return to work, you must re-enroll in the Dependent Care Flexible Spending Account (FSA) if you wish continue your participation in this plan. If you fail to re-enroll, your annual Dependent Care FSA will be adjusted to reflect your year-to-date contribution. December 1 is the cutoff to make any changes to current benefit year.
PTO Accrual PTO accrual ceases after 180 days
NTO No Impact
Holiday Pay Eligible, less any military pay received
Business Travel Accident Insurance Coverage ceases at midnight on the last day of your active status as a Veritas employee.
Critical Illness Insurance If three semi-monthly payroll deductions are missed, MetLife will begin to direct bill you on a quarterly basis and services will continue as long as you remit payment to MetLife
Pet, Auto and Home Insurance Contributions and coverage cease after the week-long elimination period. MetLife will bill you directly and services will continue as long as you remit payment to MetLife
Tuition Reimbursement Program Ineligible.
ARAG Group Legal plan Coverage ceases. You may re-enroll upon return to work.
401(k) plan Contributions cease. Loan payments may be suspended under certain circumstances (refer to the 401(k) SPD for details). Vesting is subject to the terms of the Plan.
Bonus Program If you have eligible compensation as defined by the plan, you may be eligible to continue in the Veritas Bonus Program.
Employee Stock Purchase Plan (ESPP) Participation may continue for the first 180 days of active reserve military leave.

Return to Work

You must notify your immediate manager and Liberty of the intention to return to work (view notification requirements).

Upon reemployment, you are entitled to all rights and benefits attained prior to military reservist leave, plus all rights and benefits you would have attained had you remained continuously employed by the company.

If you are unable to return to work at the end of the military leave, your employment with Veritas may be terminated as of the last day of the approved leave.

Reservist Leave

A military leave is a Leave of Absence which will be granted to fulfill short-term military obligations in compliance with federal and state regulations. All full and part-time employees are eligible.

Reservists will be granted up to two weeks annual military leave and you will receive regular pay from Veritas less any military pay received. Please advise the HR vHelp and the Veritas Payroll Department of all earnings received from military duty as soon as possible to avoid overpayment.

Time off taken in excess of two weeks will not be paid by Veritas, however PTO or NTO AADs may be used in this situation.

Exempt employees must request time off for Military Reservist Leave using Workday. Non-exempt employees must request the leave using eTime.

Returning to Work
Upon re-employment, you are entitled to all rights and benefits attained prior to military reservist leave, plus all rights and benefits you would have attained had he/she remained continuously employed by the company.

If you are unable to return to work at the end of the military leave, your employment with Veritas may be terminated as of the last day of the approved leave.
